The limited liability company “Express-2”, hereinafter is referred to as EXECUTOR, which acts based on contracts with the state enterprise “Donetsk railway”, the state territorial-branch enterprise “Lvov railway”, the state enterprise “Odessa railway”, the authorized territorial-branch “South railway”, the state territorial-branch enterprise “ South-western railway”, the state enterprise “Dnieper region railway” publishes this Public Offer Contract on offering services in Automated Self-service system «е-Kvytok », hereinafter – Contract, as follows:

1. SUBJECT OF CONTRACT

EXECUTOR renders the following services (hereinafter Services) by means of Automated Self-service system:

• Online booking of seats/berths (with subsequent purchase of travel documents in the ticket office),
• Online order of travel (transportation) documents (with subsequent printing out and receiving the travel (transportation) documents in the ticket office).

EXECUTOR renders Services according to Rules for use of Automated Self-service system "e-Kvytok" and Prices for services of Automated Self-service system "e-Kvytok"

Services CUSTOMER is a person, which agreed to all terms of the present Contract, ordered Services and paid for them. Service is deemed to be rendered by EXECUTOR and received by CUSTOMER in full from the moment of presenting of unique Internet-order number to CUSTOMER via Automated Self-service system “e-Kvytok” in form, which allows coping this number or printing it with the Internet-order form.

2. PRICES AND PAYMENT TERMS

2.1. CUSTOMER prepays 100% for Services via Internet by means of bank cards of the national system mass electronic payment (NSMEP) or the international payment systems (VISA, MasterCard) in accordance with these payment systems rules and Prices for services of Automated Self-service system "e-Kvytok" .

2.2. A fact of payment’s receipt by EXECUTOR is entering of an amount for the correspondent Service into the account of EXECUTOR.

2.3. If CUSTOMER refuses to trip, return of unused travel documents is performed according to the rules, established by the Ukrzaliznytsya, and only after travel documents are printed out on a set form in the ticket office.

2.4. Return of  documents executed by Automated Self-service system “e-Kvytok” and paid by cards of the national system mass electronic payment (NSMEP) will be refunded by cash.

2.5. Return of  documents executed by Automated Self-service system “e-Kvytok” and paid by Visa or Master Card will be refunded by bank transfer to the account used for payment.

3. RIGHTS AND OBLIGATIONS OF PARTIES

3.1. EXECUTOR is obliged:

• To render Services stipulated by the terms of this Contract;
• To give consultations concerning the Services;
• To maintain confidentiality of CUSTOMER information received from CUSTOMER during registration, excluding cases specified by current legislation of Ukraine;

3.2. EXECUTOR has the right:

• To stop Services in connection with necessary works;

3.3. CUSTOMER is obliged:

• To perform all the terms of this Contract.

3.4. CUSTOMER has the right:

• To require EXECUTOR to render Services in accordance with the terms of this Contract.

4. PARTIES’ RESPONSIBILITY AND DISPUTE SETTLEMENT

4.1. The quality of communication channels, by means of which  access to Services is effected, is beyond the responsibility of the present Contract Parties.

4.2.CUSTOMER is responsible for keeping login and password confidential. All deeds with CUSTOMER’s login and password are deemed to be made by CUSTOMER.

4.3. All disputes arising from rendering of Services to CUSTOMER are settled by the parties by usage of CUSTOMER’s personal information provided by CUSTOMER during registration.

4.4. Using the service of Online booking of seats/berths (with subsequent purchase of travel documents in the ticket office), CUSTOMER is responsible for timely purchase of travel documents in the ticket office.

4.5. Using the service of Online order of travel (transportation) documents (with subsequent printing out and receiving the travel (transportation) documents in the ticket office). CUSTOMER is responsible for timely collection of travel (transportation) documents in the ticket office.

The person who receives travel (transportation) documents in the ticket office is obliged to show identity papers to a cashier.

4.6. All disputes arising within this Contract or in connection with its fulfillment are to be settled by parties by means of negotiations. The pre-trial procedure for dispute settlement is obligatory.

4.7. All disputes are considered if there is written application sent by post.

4.8. If the parties can not reach consensus by means of negotiations, disputes are to be settled in accordance with the current legislation of Ukraine.

4.9. All the questions not stipulated in the text of this Contract, if any, are governed by the current legislation of Ukraine.

5. OTHER TERMS

5.1. This Contract comes into force from the date of payment by CUSTOMER for EXECUTOR’S Services.
