PUBLIC OFFER CONTRACT
on offering services in Automated Self-service system «е-Ticket»

The limited liability company “Express-2”, hereinafter is referred to as EXECUTOR, which acts based on contracts with the state enterprise “Donetsk railway”, the state territorial-branch enterprise “Lvov railway”, the state enterprise “Odessa railway”, the authorized territorial-branch “South railway”, the state territorial-branch enterprise “ South-western railway”, the state enterprise “Dnieper region railway” publishes this Public Offer Contract on offering services in Automated Self-service system «е-Ticket», hereinafter – Contract, as follows:
1. SUBJECT OF CONTRACT
EXECUTOR renders the following services (hereinafter Services) by means of Automated Self-service system (hereinafter ASSS “e-Ticket”):
- Online booking of seats (in order to buy tickets in a ticket office later),
- Online order of travel (transportation) documents (which to be printed and received in a ticket office later).
EXECUTOR renders Services according to
Rules for use of Automated Self-service system ?e-Ticket?
and
Prices for services of Automated Self-service system ?e-Ticket?
CUSTOMER of Services is considered a legal entity or a physical person, which orders Services for its own needs, has agreed to all terms of the present Contract and paid for Services. Service is deemed to be rendered by EXECUTOR and received by CUSTOMER in full from the moment of presenting an unique number of online booking in form, which allows coping this number or printing it with the Online booking form, to CUSTOMER through ASSS “e-Ticket”. The terms of this Contract are equal for all CUSTOMERS.
2. PRICES AND PAYMENT TERMS
2.1. CUSTOMER prepays 100% for Services through Internet by means of bank cards of the national mass electronic payments system or the international payments systems (VISA, MasterCard) in accordance with the rules of these payments systems and stipulated prices of EXECUTOR.
2.2. A fact of payment’s receipt by EXECUTOR is entering of an amount for the correspondent Service into the account of EXECUTOR.
2.3. In case of return of travel (transportation) documents, reserved by means of ASSS “e-Ticket”, the amount, which has been paid for such documents, to be reimbursed into the bankcard of CUSTOMER with some charge for travel (transportation) documents return fixed by a railway, whose ticket office makes such a return.
3. RIGHTS AND OBLIGATIONS OF PARTIES
3.1. EXECUTOR is obliged:
- To render Services stipulated by the terms of this Contract;
- To provide the possibility to pay for Services through conclusion of correspondent contracts with the banks;
- To give consultations concerning the Services;
- To maintain confidentiality of CUSTOMER information received from him during a registration, excluding cases specified by current legislation of Ukraine;
- To inform CUSTOMER about scheduled stoppage of Services on web site in advance.
3.2. EXECUTOR has the right:
- To stop Services in connection with necessary works;
- To amend the terms of this Contract and prices of Services without agreement with CUSTOMER. However all such amendments shall be presented on Executor’s web site not later than two days before coming into force.
3.3. CUSTOMER is obliged:
- To perform all the terms of this Contract.
3.4. CUSTOMER has the right:
- To require EXECUTOR to render Services in accordance with the terms of this Contract. от ИСПОЛНИТЕЛЯ предоставления Услуг в соответствии с условиями этого Договора.
4. PARTIES’ RESPONSIBILITY AND DISPUTE SETTLEMENT
4.1. The quality of communication channels, by means of which an access to Services is effected, is beyond the responsibility of Parties of the present Contract.
4.2. Each Party is only responsible for results of its own activity or inactivity that have led to disclosure of confidential information of this party.
4.3.CUSTOMER is only responsible for keeping of its login and password confidentially. All deeds with its login and password are deemed to be made by CUSTOMER on its own.
4.4. All disputes arising from rendering of Services to CUSTOMER are settled by the parties by usage of all personal data of CUSTOMER mentioned during its registration.
4.5. Using the service of Online booking of seats (in order to buy tickets in a ticket office later), CUSTOMER is responsible to buy tickets in a ticket office in time.
4.6. Using the service of Online order of travel (transportation) documents (which to be printed and received in a ticket office later) CUSTOMER is responsible to receive travel (transportation) documents in a ticket office in time.
The person who receives travel (transportation) documents in a ticket office is obliged to show its identity papers to a cashier.
4.7. All disputes arising within this Contract or in connection with its fulfillment the parties settle by means of negotiations. The pre-trial procedure for dispute settlement is obligatory.
4.8. All disputes are considered if there is written application sent by post or facsimile.
4.9. If the parties can not reach a consensus by means of negotiations such disputes to be settled in accordance with the current legislation of Ukraine.
4.10. All the questions not stipulated in the text of this Contract, if any, are governed by the current legislation of Ukraine.
5. OTHER TERMS
5.1. This Contract comes into force from the date of payment by CUSTOMER for EXECUTOR’S Service.
5.2.In case of amendments to this Contract or if it is suspended or cancelled, EXECUTOR declares about this on its web site before 2 calendar days till the correspondent date. Moreover EXECUTOR must render all Services to CUSTOMER, for which CUSTOMER has paid.
